Terms of use<\/h1><\/div>

Purpose<\/h3>\n

In addition to the general terms and conditions, the terms of use are also an integral part of the contract. The terms of use serve to protect the operating environment of WIN-WIN FOR WORK so that its service quality is not impaired in the interests of the majority of customers. Customers who pass on their server or account or parts thereof to third parties are obliged to inform them accordingly and are also liable to WIN-WIN FOR WORK for them.<\/p>\n

prohibitions<\/h3>\n

Violation of law
\n<\/strong>All data, content and activities, as well as the promotion of these or participation in such activities, which violate Swiss law are prohibited. This includes, among other things, the publication or distribution of data protected by copyright or distribution law.<\/p>\n

Racism
\n<\/strong>The publication or dissemination of racist content or backgrounds is not permitted. WIN-WIN FOR WORK reserves the right to define them in ambiguous cases.<\/p>\n

Abuse
\n<\/strong>activities, as well as the promotion of these or participation in those that are considered unwelcome according to generally known Internet rules of conduct (netiquette \/ RFC1855) are not permitted. This includes, among other things, the (multiple) unsolicited distribution of unwanted messages (spam, UCE, etc.) and attacks against other systems connected to the Internet (DDoS attacks, spoofing, etc.). WIN-WIN FOR WORK is entitled to determine the definition of netiquette and its components. Furthermore, the customer refrains from excessive bandwidth consumption, i.e. when the available network resources are impaired to the detriment of other customers.<\/p>\n

Violation<\/h3>\n

Definition
\n<\/strong>Any non-compliance or immorality with a prohibition mentioned under point 2 is considered a violation, whether intentional, unintentional or caused by a third party. Such a violation can be identified by checking reports or complaints from third parties or – depending on the case – conspicuous signs in WIN-WIN FOR WORK’s system testing mechanisms.<\/p>\n

Consequence
\n<\/strong>The decisive factor here is how serious the violation is in WIN-WIN FOR WORK’s opinion and any punishment should be proportionate. In any case and at a minimum, the customer will be warned. In the event of a serious or repeated violation, WIN-WIN FOR WORK reserves the right to terminate a contract or subscription without notice or to immediately temporarily block the affected content, service, account or server.<\/p>\n

Terms of Use for the POWER DUCK Dialog AI<\/h3>\n

1. Limitation of Liability and Responsibility of the User<\/b><\/p>\n

The POWER DUCK Dialog AI functions exclusively as a generator of recommendations for action and information. It is in no way a substitute for professional advice or independent decision-making. The user assumes full liability for all actions and decisions, including those based on the recommendations of the AI.<\/p>\n

2. Test phase and feedback gathering<\/b><\/p>\n

By using the trial version, the user agrees that WIN-WIN FOR WORK may contact him for the purpose of collecting feedback. This feedback is used to continuously optimize the POWER DUCK Dialog AI.<\/p>\n

3. Voluntary use and exclusion of warranty<\/b><\/p>\n

The use of the POWER DUCK Dialog AI is voluntary and does not give rise to any legal claims against WIN-WIN FOR WORK GmbH, in particular no warranty or liability claims with regard to the recommendations of the AI.<\/p>\n

4. Restriction and denial of use<\/b><\/p>\n

WIN-WIN FOR WORK reserves the right to restrict or refuse the use of POWER DUCK Dialog AI at any time and without giving reasons.<\/p>\n

5. Changes to the Terms of Use<\/b><\/p>\n

WIN-WIN FOR WORK GmbH is entitled to change these terms of use at any time. It is the user’s responsibility to inform themselves about the current terms of use.<\/p>\n
